The terms and conditions that govern your use of our website and engagement of our services.
1. Acceptance of Terms
By accessing and using the Patterdale Recovery Limited website and/or engaging our services, you agree to be bound by these Terms of Service.
These Terms, together with the Client Agreement and Privacy Policy, constitute the entire agreement between you and Patterdale Recovery Limited.
We reserve the right to update these Terms at any time. Material changes will be notified via a prominent notice on our Website.
2. Service Description
Patterdale Recovery Limited provides specialist fraud investigation and asset recovery services including case assessment, forensic investigation, blockchain analysis, and coordination with legal partners.
The specific scope of services is defined in a separate Client Agreement. We do not provide legal advice directly.
3. Eligibility
You must be at least 18 years of age, a victim of fraud or acting on behalf of a victim with legal authority, and have the legal capacity to enter into a binding agreement.
We reserve the right to decline any engagement at our sole discretion.
4. Client Obligations
You agree to provide accurate and truthful information, cooperate fully with investigations, notify us of changes in circumstances, and maintain confidentiality.
Prolonged non-response may result in case suspension or closure.
5. Fee Structure
Your initial case review is always free and carries no obligation. Fees for any subsequent work vary depending on the complexity, scope and jurisdiction of each individual case.
Depending on your case, fees may be structured as a success-based percentage, an upfront or staged fee, or a combination of these. All fees, the scope of work and any third-party or disbursement costs are set out and agreed in writing before any paid work commences. We do not guarantee any specific recovery amount or outcome.
6. Payment Terms
Recovered funds are held in a secure client account. Our fee is deducted and the balance transferred via secure bank transfer.
All transactions comply with anti-money laundering regulations.
7. Cancellation Policy
14-day cooling-off period from signing the Client Agreement. After that, 30 days written notice required.
We may suspend services if you breach Terms, provide false information, or fail to cooperate.
8. No Guarantee of Recovery
We cannot guarantee recovery in any individual case. Success depends on numerous factors including fraud complexity, jurisdictions, and evidence availability.
We provide an honest assessment. If recovery is not viable, we will inform you clearly.
9. Limitation of Liability
Our total liability shall not exceed the fees paid for the specific engagement. We are not liable for indirect, consequential, or punitive damages.
Nothing limits liability for death, personal injury, fraud, or liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify Patterdale Recovery Limited from claims arising from your breach of Terms, false information, or unlawful use of services.
11. Confidentiality
Both parties maintain strict confidentiality. We will not disclose your identity or case details without written consent, except where required by law.
Confidentiality obligations survive termination indefinitely.
12. Intellectual Property
All Website content is owned by or licensed to Patterdale Recovery Limited. You may not reproduce content without prior written consent.
Reports prepared for your case remain our intellectual property; copies provided for personal use.
13. Force Majeure
Neither party is liable for delays due to circumstances beyond reasonable control. If continuing for 90+ days, either party may terminate with written notice.
14. Dispute Resolution
Step 1: Contact your case manager. Step 2: Escalate to complaints@patterdalerecovery.co.uk. Step 3: Independent ADR after 8 weeks.
Both parties agree to attempt good faith negotiation before formal proceedings.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
16. General Provisions
Entire agreement includes these Terms, Client Agreement, and Privacy Policy. Waiver of any provision does not constitute waiver of others.
You may not assign rights without our consent. Third-party rights are not conferred except as expressly stated.
